1. Scope

These Terms of Service apply to the use of the app “LayPic” (hereinafter “App”), provided by:

2. Description of Services

LayPic is a photo collage editor for iOS (iPhone and iPad). The app enables users to create photo collages with various layouts, masks, text overlays, and export options. All image processing happens locally on the user’s device.

3. Free Version and Advertising

LayPic is available for free with the following limitations:

Advertisements are displayed via Google AdMob (banner and interstitial ads).
Exported images include a “LayPic” watermark.
Mask templates are not available.

These limitations can be removed by subscribing to LayPic Pro.

4. LayPic Pro Subscription

4.1 Subscription Options

Monthly: 1.99 € per month
Yearly: 12.99 € per year

All prices include applicable VAT.

4.2 Subscription Features

LayPic Pro includes:

No advertisements
No watermark on exported images
Access to all mask templates (hearts, wedding, numbers)

4.3 Billing and Renewal

Payment is charged to your Apple ID account at confirmation of purchase.
The subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscription in your Apple ID account settings.

4.4 Apple EULA

In-app purchases are additionally subject to the Standard Apple End User License Agreement (EULA).

5. Right of Withdrawal

In accordance with the EU Directive on digital content (2019/770) and §§ 327 ff. BGB (German Civil Code), you have a 14-day right of withdrawal from the date of purchase as a consumer.

Note: The right of withdrawal expires prematurely if you have expressly agreed that performance of the contract may begin before the withdrawal period has expired, and you have acknowledged that you thereby lose your right of withdrawal. This occurs as part of the Apple purchase process.

For refunds, please contact Apple Support directly, as purchases are processed through Apple’s payment system.

6. User Content

You retain all rights to the photos and images you use in LayPic. The app does not claim any ownership or license to your content. All processing happens locally on your device.

7. Limitation of Liability

We are liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.

For slight negligence, we are only liable in cases of breach of material contractual obligations (cardinal obligations). In such cases, liability is limited to the foreseeable damage typical to the contract.

We are not responsible for the quality or suitability of exported collages for specific purposes (e.g., professional printing). Use of the app is at your own risk.

8. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.

9. EU Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

10. Changes to the Terms of Service

We reserve the right to update these Terms of Service as needed. Changes will be published in the app or on this website. Continued use of the app after publication of amended Terms of Service constitutes acceptance.
